Terms of Service

Please read these Terms of Service ("Terms") carefully before using the StudioAI iOS application and related services (the "Service") operated by StudioAI ("we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

StudioAI is a native iOS language-learning application that allows users to upload learning materials and generate AI-powered flashcards, quizzes, audio summaries, and structured CEFR learning paths. The Service includes:

You must be at least 13 years old (or 16 in the EU) to use StudioAI. By creating an account, you represent that you meet this requirement. If you are using StudioAI on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Free Tier

StudioAI offers a free tier with limited access to CEFR learning path units and Studio features.

Auto-Renewable Subscriptions

StudioAI offers auto-renewable subscriptions through Apple In-App Purchase:

  • StudioAI Pro Monthly (1 month)
  • StudioAI Pro Yearly (1 year)
  • Studio Pass: one-time purchase

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings.

Free Trials

Any unused portion of a free trial, if offered, will be forfeited when purchasing a subscription. Where offered, free trials automatically convert to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the end of the trial period.

Refunds

All purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. We do not process refunds directly.

Price Changes

We may change subscription prices with reasonable notice. Price changes take effect at the next renewal period.

5. User-Uploaded Content

You retain ownership of all content you upload to StudioAI (PDFs, text, YouTube links). By uploading content, you grant us a limited, non-exclusive license to process that content solely for the purpose of generating your study materials.

6. AI-Generated Content

Flashcards, quizzes, audio summaries, and other content generated by our AI systems are provided for educational purposes only.

The StudioAI application, its design, code, branding, and all content created by us (excluding user-uploaded materials and AI output derived from them) are owned by StudioAI and protected by copyright, trademark, and other intellectual property laws.

You may not copy, distribute, or create derivative works from our proprietary content without express written permission.

9. Open Source Notices

StudioAI incorporates open-source software. Attribution and license information is available within the app at Settings → About → Licenses. Key components include the FSRS algorithm (MIT), Firebase iOS SDK (Apache 2.0), and others listed therein.

Your use of StudioAI is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

We strive to maintain a reliable service but do not guarantee uninterrupted availability. We may:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, that AI-generated content will be accurate, or that the Service will meet your specific learning objectives.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STUDIOAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR LEARNING PROGRESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

Nothing in these Terms limits or excludes StudioAI's liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law. Users in the European Union retain all mandatory rights under the consumer protection law of their country of residence, which shall prevail over the limitations above to the extent required by applicable law.

14. Indemnification

You agree to compensate StudioAI for direct and proven damages arising solely from: (a) your intentional or grossly negligent violation of these Terms; or (b) your infringement of a third party's intellectual property rights through content you deliberately upload in breach of Section 5.

This clause does not apply to the extent prohibited by mandatory consumer protection law applicable in your country of residence. Nothing in this section shall be construed to require you to cover StudioAI's legal costs in a general or preventive manner.

15. Termination

We may suspend or terminate your account if you violate these Terms. For users on a paid subscription, we will provide at least 7 days' advance notice before termination for Terms violations, except in cases of serious violations (including but not limited to: uploading illegal content, fraud, security attacks, or impersonation), where immediate termination without notice may apply.

If we terminate your paid account without cause, we will issue a pro-rated refund for the unused portion of your current subscription period, processed through Apple's standard refund procedures.

You may delete your account at any time from Settings → Account → Delete Account. Upon termination, your right to use the Service ceases and we will delete your data as described in the Privacy Policy.

16. Governing Law and Dispute Resolution

These Terms are governed by Spanish law. Any dispute arising from or related to these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

Notwithstanding the above, if you are a consumer residing in the European Union, the mandatory consumer protection provisions of your country of residence shall apply and shall prevail over the above choice of law to the extent required by applicable law.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app or by email. Continued use of StudioAI after the effective date of the new Terms constitutes your acceptance.
